Welcome to StudyMax. Please read these Terms & Conditions (“Terms”) carefully before using our software or website. By accessing or using StudyMax, you agree to be bound by these Terms.

1. Definitions

  • “StudyMax” means the software application and accompanying website owned and operated by StudyMax.

  • “User”, “you” or “your” means any individual or entity accessing or using StudyMax.

  • “Licence” means the right, granted to you under these Terms, to use StudyMax subject to the restrictions below.

2. Acceptance of Terms

By downloading, installing or using StudyMax, you confirm that you have read, understood and accepted these Terms. If you do not agree, you must not use StudyMax.

3. Licence Grant & Restrictions

  1. Grant: StudyMax grants you a personal, non-exclusive, non-transferable licence to use StudyMax on your compatible device(s) for your own or your child’s educational purposes.

  2. Restrictions: You must not:

    • Copy, modify, distribute or create derivative works of StudyMax.

    • Reverse-engineer, decompile or attempt to extract source code.

    • Circumvent any technological protection measures.

    • Use StudyMax to provide services to third parties for commercial gain (unless you hold a valid multi-seat or school licence).

4. Subscriptions & Payment

  1. Plans: We offer the Essential and Insight subscription plans, billed monthly, every 3 months, every 6 months and annually. Details are published on our Pricing page.

  2. Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled.

  3. Payment: All fees are payable in euro via accepted payment methods (credit/debit card, PayPal). You are responsible for any transaction fees or taxes.

  4. Changes to Fees: StudyMax may change its subscription fees at renewal; we will notify you at least 30 days in advance.

5. Cancellation & Refunds

  1. Cancellation: You may cancel at any time via your account settings; access remains until the end of the current billing period.

  2. Refunds: We offer a 14-day money-back guarantee on new subscriptions. Beyond 14 days, refunds will not be issued for partial periods.

6. User Conduct

You agree not to:

  • Use StudyMax for any unlawful purpose or in a way that violates any applicable regulations.

  • Submit or upload any content that is abusive, defamatory, infringing or otherwise objectionable.

  • Interfere with or disrupt StudyMax or its servers or networks.

7. Intellectual Property

All rights, title and interest in StudyMax (including software, design, text, graphics, logos and database content) remain owned by StudyMax or its licensors. The “StudyMax” name and logo are trade-marks of StudyMax.

8. Privacy

Your use of StudyMax is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect and use your personal data.

9. Disclaimers & Limitation of Liability

  1. No Warranty: StudyMax is provided “as is” and “as available.” We make no warranties, express or implied, about its suitability, reliability or accuracy.

  2. Limitation: To the fullest extent permitted by law, StudyMax shall not be liable for any indirect, incidental, special or consequential damages arising from your use of StudyMax.

10. Indemnity

You agree to indemnify and hold harmless StudyMax, its officers and employees from any claims, damages or losses arising from your breach of these Terms or your misuse of StudyMax.

11. Termination

StudyMax may suspend or terminate your access immediately if you breach these Terms. Upon termination, your licence ends and you must cease all use of StudyMax.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Ireland. Any disputes arising will be subject to the exclusive jurisdiction of the Irish courts.

13. Changes to These Terms

StudyMax may revise these Terms from time to time. We will post any updates on our website and indicate the “Last updated” date. Your continued use of StudyMax after changes constitutes acceptance of the new Terms.
